1. Acceptance of Terms

By installing or using Car Merge Tycoon, you confirm that:

• You are at least 13 years old, or have parental consent to use the App
• You have the legal capacity to enter into these Terms
• You will use the App in compliance with all applicable laws and regulations

2. Description of Service

Car Merge Tycoon is an idle merge tycoon game that provides:

• A merge mechanic where you combine cars to create higher tier vehicles
• A racing track where deployed cars earn coins
• Idle earnings that accumulate even when the app is closed
• Various upgrades for parking, track, speed, and earnings
• Boost systems and special events
• Optional in-app purchases and rewarded advertisements

3. Game Currency and Virtual Items

3.1 Virtual Currencies

Car Merge Tycoon uses the following virtual currencies:

• Coins: Earned through gameplay, used for basic purchases
• Gems: Premium currency for boosts and special items
• Gold Coins: Currency for permanent multipliers

3.2 Virtual Items

• Virtual currencies and items have no real-world monetary value
• Virtual items cannot be sold, traded, or exchanged outside the App
• We reserve the right to modify virtual item values and availability

4. In-App Purchases

4.1 Purchase Terms

• In-app purchases are processed through Apple App Store or Google Play Store
• Payment will be charged to your App Store or Play Store account
• All purchases are final and non-refundable except as required by law

4.2 Pricing

• Prices are displayed in your local currency within the App
• We reserve the right to change pricing with reasonable notice
• Price changes will not affect previously completed purchases

4.3 Refunds

• Refund requests are handled by Apple or Google according to their respective policies
• We do not directly process refunds for in-app purchases

5. Advertisements

Car Merge Tycoon displays advertisements to support free gameplay:

• Rewarded Ads: Optional video ads that provide in-game bonuses (double earnings, free cars, time warps)
• Interstitial Ads: Full-screen ads shown between gameplay sessions
• Banner Ads: Small advertisements displayed during gameplay

Watching rewarded ads is always optional. Standard gameplay does not require watching any advertisements.

6. Acceptable Use

You agree NOT to:

• Use cheats, exploits, automation software, hacks, or any unauthorized third-party software
• Modify, reverse engineer, decompile, or disassemble the App
• Exploit bugs or glitches to gain unfair advantages
• Manipulate game time or system clock to gain extra offline earnings
• Use the App for any unlawful purpose
• Interfere with or disrupt the App's servers or networks
• Attempt to gain unauthorized access to any part of the App
• Resell, sublicense, or commercially exploit the App or its content

7. Intellectual Property

7.1 Our Content

• All content in Car Merge Tycoon, including graphics, animations, sounds, music, and game mechanics, is owned by Appsphere LLC or our licensors
• Content is protected by copyright, trademark, and other intellectual property laws
• You may not copy, modify, distribute, sell, or lease any part of our content

7.2 Trademarks

• "Car Merge Tycoon" and our logos are trademarks of Appsphere LLC
• You may not use our trademarks without prior written permission

8. Privacy

Your use of Car Merge Tycoon is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

9. Disclaimers

9.1 "As Is" Service

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2 No Guarantees

We do not guarantee that:

• The App will be uninterrupted, secure, or error-free
• Game progress will never be lost
• Defects will be corrected
• The App will meet your specific requirements

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• APPSPHERE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR IN-APP PURCHASES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM
• WE ARE NOT LIABLE FOR ANY LOSS OF GAME PROGRESS, VIRTUAL ITEMS, OR VIRTUAL CURRENCY
• SOME JURISDICTIONS DO NOT ALLOW LIMITATION OF LIABILITY, SO THESE LIMITATIONS MAY NOT APPLY TO YOU

11. Account Termination

11.1 Termination by You

• You may stop using the App at any time by uninstalling it
• Uninstalling will not automatically refund any purchases made

11.2 Termination by Us

We may suspend or terminate your access immediately if we believe you have:

• Violated these Terms
• Used cheats, hacks, or exploits
• Manipulated game data or time settings
• Engaged in fraudulent activity
• Acted in a way harmful to other players or our business

11.3 Effect of Termination

Upon termination:

• Your right to use the App will immediately cease
• You will lose access to all virtual currencies, items, and progress
• You will not be entitled to refunds

12. Modifications to Service and Terms

12.1 Service Changes

• We may modify, update, or discontinue any part of the App at any time
• Game balance, virtual item values, and features may change
• We are not liable for any modification, suspension, or discontinuation

12.2 Terms Changes

• We may update these Terms from time to time
• We will notify you of material changes through the App or app store update notes
• Continued use after changes constitutes acceptance of the new Terms

13. Governing Law and Disputes

13.1 Governing Law

These Terms are governed by the laws of the State of Michigan, United States, without regard to conflict of law principles.

13.2 Dispute Resolution

• You agree to first attempt to resolve any dispute informally by contacting us
• If informal resolution fails, disputes shall be resolved through binding arbitration
• Arbitration shall be conducted in Michigan under the rules of the American Arbitration Association
• You waive any right to participate in class action lawsuits or class-wide arbitration

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Appsphere LLC regarding the App.

14.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

14.3 Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

14.4 Assignment

You may not assign or transfer these Terms without our consent. We may assign our rights without restriction.

If you downloaded Car Merge Tycoon from the Apple App Store, you also agree that:

• These Terms are between you and Appsphere LLC, not Apple
• Apple has no obligation to provide maintenance or support for the App
• Apple is not responsible for any product warranties or claims
• Apple is not responsible for addressing any claims related to the App
• Apple is a third-party beneficiary of these Terms

17. Google Play Store Additional Terms

If you downloaded Car Merge Tycoon from Google Play, you also agree to comply with Google Play's Terms of Service in addition to these Terms.
