By creating an account or using StoryBrook, you confirm that:

• You are at least 18 years old, or you are the parent or legal guardian of a minor using the App
• You have the legal capacity to enter into these Terms
• You will use the App in compliance with all applicable laws and regulations

2. Description of Service

StoryBrook is a children's bedtime story application that provides:

• A library of pre-made illustrated stories with audio narration
• AI-generated personalized stories featuring your child's name
• Multiple child profiles with customizable settings
• Background music and audio playback features
• Offline story access for downloaded content
• Subscription-based premium features

3. Account Registration

To use certain features of StoryBrook, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your login credentials secure and confidential
• Not share your account with others or allow unauthorized access
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

4. Subscription and Payments

4.1 Free and Premium Features

• StoryBrook offers both free content and premium subscription features
• Some stories and features require an active subscription

4.2 Subscription Terms

• Subscriptions are billed through Apple App Store or Google Play Store
• Payment will be charged to your App Store or Play Store account
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• You can manage and cancel subscriptions through your device's account settings

4.3 Pricing

• Subscription prices are displayed in the App and may vary by region
• We reserve the right to change pricing with reasonable notice
• Price changes will not affect your current subscription period

4.4 Refunds

• Refund requests are handled by Apple or Google according to their respective policies
• We do not directly process refunds for in-app purchases

4.5 Free Trials

• Free trial eligibility is determined by the App Store or Play Store
• If you do not cancel before the trial ends, you will be charged for the subscription

5. Acceptable Use

You agree NOT to:

• Use the App for any unlawful purpose or in violation of these Terms
• Share, distribute, or reproduce any content from the App without authorization
• Attempt to reverse engineer, decompile, or disassemble the App
• Circumvent, disable, or interfere with security features of the App
• Use automated systems, bots, or scripts to access the App
• Share account credentials or subscription access with others
• Impersonate any person or entity
• Upload, transmit, or distribute any viruses or malicious code
• Interfere with or disrupt the App's servers or networks
• Harvest or collect user information without consent
• Use the App in any way that could damage our reputation or business
• Resell, sublicense, or commercially exploit the App or its content

6. Intellectual Property

6.1 Our Content

• All content in StoryBrook, including stories, illustrations, audio, music, text, graphics, logos, and software, is owned by Appsphere LLC or our licensors
• Content is protected by copyright, trademark, and other intellectual property laws
• You may not copy, modify, distribute, sell, or lease any part of our content

6.2 AI-Generated Content

StoryBrook uses artificial intelligence to create the following content:

• Story Text: Personalized stories are generated using AI language models
• Voice Narration: All story narration is created using AI text-to-speech technology, not human voice actors
• Illustrations: Story images are created using generative AI image technology

Regarding AI-generated content:

• AI-generated content is for your personal, non-commercial use only
• We retain rights to the underlying AI technology and generation methods
• You may not claim ownership of or commercialize AI-generated stories, narration, or illustrations
• AI-generated content may vary in quality and occasionally produce unexpected results

6.3 Trademarks

• "StoryBrook" and our logos are trademarks of Appsphere LLC
• You may not use our trademarks without prior written permission

7. User-Generated Content

7.1 Child Profiles

• You are responsible for the names and information you provide for child profiles
• Do not include inappropriate, offensive, or personally identifiable information beyond first names

7.2 Content Guidelines

• All user inputs must be appropriate for a children's application
• We reserve the right to filter or reject inappropriate content

8. Privacy

Your use of StoryBrook is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

9. Children's Safety

StoryBrook is designed for use by children under parental supervision. We are committed to:

• Complying with the Children's Online Privacy Protection Act (COPPA)
• Not displaying behavioral advertising to children
• Not collecting unnecessary personal information from children
• Providing age-appropriate content

Parents and guardians are responsible for supervising their children's use of the App.

10. Disclaimers

10.1 "As Is" Service

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10.2 No Guarantees

We do not guarantee that:

• The App will be uninterrupted, secure, or error-free
• Content will be accurate, reliable, or complete
• Defects will be corrected
• The App will meet your specific requirements

10.3 AI Content

StoryBrook content is created using artificial intelligence technologies:

• Stories: Generated by AI language models and may occasionally produce unexpected or imperfect results
• Voice Narration: Created using AI text-to-speech synthesis, not recorded by human voice actors
• Illustrations: Generated by AI image models and may vary in style or quality

We continuously work to improve AI content quality but cannot guarantee perfection. By using StoryBrook, you acknowledge and accept that content is AI-generated.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• APPSPHERE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM
• WE ARE NOT LIABLE FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL
• SOME JURISDICTIONS DO NOT ALLOW LIMITATION OF LIABILITY, SO THESE LIMITATIONS MAY NOT APPLY TO YOU

12. Indemnification

You agree to indemnify, defend, and hold harmless Appsphere LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit or transmit through the App

13. Account Termination

13.1 Termination by You

• You may delete your account at any time through the App settings
• Deleting your account will not automatically cancel active subscriptions

13.2 Termination by Us

We may suspend or terminate your account immediately, without prior notice, if we believe you have:

• Violated these Terms or any applicable laws
• Engaged in fraudulent activity, abuse, or misuse of the service
• Shared account credentials or unauthorized access
• Circumvented subscription or payment systems
• Used the service for any unlawful or unauthorized purpose
• Engaged in harassment, offensive conduct, or inappropriate use
• Used spam, automated access, or bot activity
• Acted in a way harmful to other users, third parties, or our business

13.3 Effect of Termination

Upon termination:

• Your right to use the App will immediately cease
• We may delete your account data per our retention policies
• Provisions that should survive termination will remain in effect
• You will not be entitled to refunds for unused subscription periods

14. Modifications to Service and Terms

14.1 Service Changes

• We may modify, suspend, or discontinue any part of the App at any time
• We are not liable for any modification, suspension, or discontinuation

14.2 Terms Changes

• We may update these Terms from time to time
• We will notify you of material changes through the App or via email
• Continued use after changes constitutes acceptance of the new Terms
• If you disagree with changes, you must stop using the App

15. Governing Law and Disputes

15.1 Governing Law

These Terms are governed by the laws of the State of Michigan, United States, without regard to conflict of law principles.

15.2 Dispute Resolution

• You agree to first attempt to resolve any dispute informally by contacting us
• If informal resolution fails, disputes shall be resolved through binding arbitration
• Arbitration shall be conducted in Michigan under the rules of the American Arbitration Association
• You waive any right to participate in class action lawsuits or class-wide arbitration

15.3 Exceptions

• Either party may seek injunctive relief in court for intellectual property violations
• Small claims court actions are permitted where applicable

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Appsphere LLC regarding the App.

16.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

16.3 Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

16.4 Assignment

You may not assign or transfer these Terms without our consent. We may assign our rights without restriction.

16.5 Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control.

16.6 No Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights.

If you downloaded StoryBrook from the Apple App Store, you also agree that:

• These Terms are between you and Appsphere LLC, not Apple
• Apple has no obligation to provide maintenance or support for the App
• Apple is not responsible for any product warranties or claims
• Apple is not responsible for addressing any claims related to the App
• Apple is a third-party beneficiary of these Terms

19. Google Play Store Additional Terms

If you downloaded StoryBrook from Google Play, you also agree to comply with Google Play's Terms of Service in addition to these Terms.
